Warranty Terms

 

Statutory Warranty and Claims

  1. The Seller guarantees delivery of products free from physical and legal defects. The Seller is liable to the Customer if the product has a physical or legal defect (statutory warranty).
  2. If the product has a defect, the Customer may:
    1. Submit a statement requesting a price reduction or withdrawal from the sales contract, provided that the Seller does not immediately (no later than 14 days from the date of delivery of the defective product to the registered office of Neonica Poland Sp. z o.o.) replace the defective product with a defect-free one or repair the defective product. The Seller may refuse if the requested action is impossible or would involve excessive costs. The costs of repair or replacement are borne by the Seller.
  3. If a claim is recognized as justified, the delivery costs are covered by the Seller. If the defect arose due to the Customer's fault and the claim is rejected, the Seller will require reimbursement of shipping and repair costs.
  4. The Seller is liable under statutory warranty if the physical defect is discovered within two years from the date of delivery. The claim for repair or replacement expires after one year, but not earlier than two years from the delivery date.
  5. For a Customer who is an entrepreneur, the statutory warranty lasts 1 year from the date of delivery.
  6. An entrepreneur loses statutory warranty rights if the goods were not inspected during the warranty period and the Seller was not immediately notified of the defect.
  7. All claims related to the goods or the sales contract should be submitted by the Customer in writing to the Seller’s address.
  8. The Seller will respond to a written claim within 14 days from the date of delivery of the claimed goods to the registered office of Neonica Poland Sp. z o.o., ul. Ossendowskiego 6A, 93-228 Łódź.
  • Claims should be submitted electronically via the E-mail.
  1. The submission must include a description of the issue, any photos or videos, and a copy of the purchase documents (receipt or VAT invoice).
  2. The Seller does not participate in out-of-court dispute resolution as referred to in the Act of September 23, 2016 on out-of-court consumer dispute resolution.
 

Warranty Conditions

This warranty does not cover any indirect or consequential damages, including data loss or lost profits, and does not cover additional costs such as installation/removal, costs associated with such works, or potential downtime.

The Seller's financial liability for any damages is limited solely to the cost of the purchased goods.

The warranty applies only if the product is used with power supplies, accessories, and controllers recommended by the Seller. Using other accessories, power supplies, or controllers voids the warranty.

The warranty claim is valid only if the product has been used within the allowed parameters specified in the technical specifications and installed, commissioned, and used according to the user manual.

The warranty period starts from the date of purchase.

 

1. Warranty Exclusions

Warranty claims do not cover, in particular, but not limited to, cases where the product is installed, used, or modified contrary to the manufacturer’s recommendations, including:

  • unauthorized repairs or modifications,
  • use of accessories other than those recommended by the Seller, such as connectors, aluminum profiles, power supplies, controllers, power cables, double-sided tape, etc.,
  • use of the product contrary to the user manual,
  • operation in environmental conditions not in accordance with the manual, e.g., incorrect temperature, humidity, contamination, or corrosive environments,
  • incorrect installation, including using adhesives, silicones, or tapes not recommended or supplied by the Seller,
  • exposure to overvoltage or incorrect power supply,
  • defects caused by improper installation,
  • damage caused by external factors (lightning, fire, flooding, animals),
  • problems with the power network or external services,
  • minor defects (e.g., failure of one or a few LED chips/strips),
  • damage from use contrary to instructions,
  • damage from ESD, power surges, incorrect power supply,
  • mechanical damage,
  • damage from improper installation or overheating, especially LED strips installed without aluminum profiles,
  • reaching the maximum lifespan of the product as specified by the manufacturer, and/or normal reduction of luminous flux as defined in the product specification (e.g., “L70/B10”),
  • natural changes in color temperature due to normal aging of the light source,
  • soiling and discoloration from normal use.
 

2. Basis for Claims

To make a warranty claim, the required documents must be provided and formalities completed, including:

  • Delivering the goods to Neonica Poland Sp. z o.o., ul. Ossendowskiego 6A, 93-228 Łódź,
  • Submitting the claim via the electronic form available E-mail,
  • Providing proof of purchase,
  • For extended warranties, providing a scanned signed document confirming acknowledgment of warranty conditions (sent via email to the customer account manager before purchase).
 

3. Warranty Services

Neonica Poland Sp. z o.o. reserves the right to assess the validity of a warranty claim in each case.

Granting a warranty service does not extend or reset the original warranty period.

Warranty service is granted assuming that:

  • the defect occurred during the warranty period and no exclusions apply,
  • the beneficiary has properly submitted the warranty claim.

The warranty service includes exclusively, as the sole option from Neonica:
a) free replacement or repair of the product,
b) only if the beneficiary is a direct Neonica customer.

A direct Neonica customer is one who purchased the product directly from Neonica Poland Sp. z o.o., not through a dealer or third party. If purchased from a dealer or third party, claims must be handled through that party.

In the case of replacement, Neonica reserves the right to provide an equivalent product of the same type, which may differ in features, specifications, or design from the original product.

Warranty claims and services do not cover, in particular, but not limited to:

  1. Costs of installation, assembly and disassembly, transport (including road transport), labor, planning, project management, materials, or fault detection,
  2. Other claims for damages or cost reimbursement (e.g., transport, lifts, indirect damages, lost profits, etc.).
 

4. Governing Law and Dispute Resolution

  • These Warranty Terms are governed exclusively by Polish law.
  • The exclusive venue for resolving disputes arising from or related to these Warranty Terms is the competent court for the registered office of Neonica Poland Sp. z o.o.
